Longport planners recommend ordinance changes for fire pits and pools

LONGPORT – At the behest of the Planning Board, the Board of Commissioners introduced two ordinances at its Aug. 6 meeting that deal with outdoor fireplaces and fire pits, and swimming pools, hot tubs and spas.

Both ordinances were introduced after planners discussed the need to protect homeowners against fire hazards and accidental drowning, Mayor Nicholas Russo said. The borough’s fire officials also reviewed the ordinances before they were introduced.

Ordinance 2014-10 requires all wood-burning fireplaces to be located in the rear yard and attached to the main structure of the building, protruding no more than three feet from the building and no wider than eight feet. Natural gas or propane fireplaces that are not attached must meet the height requirements for accessory structures and located outside of the setback areas.

Fire pits using natural gas or propane must be less than three feet in height, within the permitted setbacks for decks and have at least a half-inch of cement board beneath the pit.

Wood burning portable metal fire pits and chimineas, may be no larger than 30-by-30 inches, and 36 inches in height and placed at least three feet from the property line.

Ordinance 2014-11 requires a four-foot, self-closing and lockable fence enclosure around above ground and in-ground swimming pools. The fence must be at least three feet from the water’s edge, be non-scalable and have no footholds.

Floodlights are not permitted, but pools, spas and hot tub lighting must be contained within the structure and below the water line.

Setbacks for pools must be at least five feet from the property line and three feet from any structure.

Oceanfront lots or those on Risley Channel have a minimum setback from the bulkhead or seawall of at least three feet, and 10 feet from the front yard property line.

A public hearing on the ordinances will be held at the next commission meeting, 4:30 p.m. Aug. 20.

In other business, the board approved a 15-year contract with a 10-year extension for Comcast to provide cable services to Longport residents. Longport will receive $12,500 worth of technology improvements that meet the needs of the community.
